I've been farming the Stone Bat's in Deepholm for days (for skinning), and I had this design drop. I can confirm that it's not BoP, I put it in the Auction House with no issues.
Edit: I should also mention that I don't have Jewel Crafting.. I'm a Skinner/Leatherworker :)
This dropped for me on a toon that does not have Jewelcrafting... don't know if that's a bug or if they've taken out the filter that hides recipes from non-professionals (or this is just a world bop recipe, deal with it, kind of thing). It made me sad though that I can't send it to my JC.

It's not BoP on live. Just had it drop for me on my rogue and was able to place it on the AH.
This plan dropped for me on my shaman from a Nightmare Terror in Hyjal. I was able to send it in game to my mage which is my Jewelcrafter without problem.
Dropped in (H) Wells of Eternity from trash for me
Dropped for me in Deepholm on my Shaman, which is Herbalism and Alchemy. Must be just a normal drop still.
