It USED to scale by your engineering level, so you could have a guardian that was like 20 levels higher than the mobs you were going after. Now, it's always level 40, I believe. Just now, i tried it on my 450 engineer, and it was 40.
A handy little bugger. I just only wish he would stay more than a minute, or that you could summon it more often than every 60 minutes.
Just keep in mind that it's not like other pets, you can' order it to attack, it just does when you get attacked.
