Able to confirm that this is indeed a bug and a fix for it should be coming out very soon -
Confirmed that work around is creating a macro and using the commands:
#showtooltip Mutilate
/cast Mutilate

And it's kinda sorta correct, even!. (There really should be a roll-eye smiley.)It is correct that the lowest level players can't use [spell=1329], because they can't even select a specialization yet, but once they reach level 10, they can select Assassination and doing that is what automatically awards [spell=1329], which is the "signature ability" for that specialization. It might be true that you have to spend at least one talent point to lock in the fact that you selected Assassination (I'm not sure), but other than that, it's not really the spending of talent points that gives it. (It's not directly on the tree.)
But yes, it's something that can be ignored by those below level 10 and anyone who didn't select Assassination. If you do select Assassination, it might be necessary to use the macro mentioned a few comments above to be able to put [spell=1329] on a button, though.
It sure would be nice if they would just fix it sometime! (Edit: Fixed by 4.3. :) )
